Divers Alert Network Releases Statement About Legal Filing

DURHAM, NC – June 26, 2026 – Divers Alert Network® (DAN®) is aware of public discussion regarding a declaratory judgment action filed by its insurance entity, DAN Risk Retention Group, Inc., in connection with pending litigation in Texas.

The circumstances surrounding the pending litigation involve a tragic loss, and the entire DAN organization extends its sincere concern to all those affected. Out of respect for the family, the parties, our insureds, and the judicial process, we will not comment on the facts of the underlying litigation, the merits of any allegations, litigation strategy, or specific insurance coverage positions beyond the public court record.

However, it is important to distinguish between allegations, legal claims, and judicial findings.  Questions concerning liability in the underlying lawsuit and questions concerning insurance coverage are separate legal matters and will be addressed through the appropriate judicial processes. Moreover, the filing of the declaratory judgment action should not be interpreted as a statement by DAN regarding the fault of any organization or individual. It also should not be interpreted as a statement by DAN regarding the quality, adequacy, validity, or effectiveness of any training organization’s programs, educational materials, standards, certification processes, or instructional systems. Those matters, to the extent they are raised in the underlying lawsuit, are part of the litigation process and should be addressed through the courts.

The decision to seek judicial guidance on insurance coverage obligations of the DAN Risk Retention Group is separate from any assessment of training standards, educational content, agency governance, or professional conduct. The DAN organization remains committed to working with training organizations, dive professionals, dive businesses, and industry partners to advance diver safety, responsible risk management, and informed decision-making throughout the diving community.

The DAN organization’s role in dive safety, medical information, emergency assistance, research, education, and risk mitigation remains unchanged. We will continue supporting the diving public and working with industry partners while respecting the legal process now underway.
